Terms of Use

Welcome to Oddah. These Terms of Use ("Terms") govern your access to and use of the Oddah mobile application, website, and related services (the "Service") provided by Oddah ("we," "our," or "us"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. By using Oddah, you represent that you meet these requirements. The Service is intended for use by couples in a committed relationship; you are responsible for ensuring your use complies with applicable local laws.

2. Account and Registration

You must create an account to use certain features. You agree to provide accurate, current, and complete information and to update it as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

3. Partner Connection

Oddah allows you to link your account with a partner. You may only invite someone who has agreed to be your partner in the app. You are responsible for your choice of partner and for any content you share within your couple space. We are not responsible for disputes between partners or misuse of shared access.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws.
• Harass, abuse, threaten, or harm others, or post content that is defamatory, obscene, or infringing.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Reverse engineer, scrape, or automate access to the Service except as permitted.
• Resell, sublicense, or commercially exploit the Service without our written permission.

We may suspend or terminate your account if we reasonably believe you have violated these Terms or abused the Service.

5. Subscriptions and Payments

Some features are available through paid subscriptions (e.g., monthly, yearly, or lifetime plans). Payment is processed through the applicable app store (Apple App Store or Google Play). Subscription terms, renewals, cancellations, and refunds are governed by the app store's policies. We may change subscription offerings and pricing with notice; continued use after changes constitutes acceptance.

6. Your Content and Licences

You retain ownership of content you create and share on the Service. By posting content, you grant us a limited licence to use, store, display, and process it as necessary to provide and improve the Service (e.g., syncing with your partner, backups, analytics). You represent that you have the right to share such content and that it does not violate any third-party rights or these Terms.

7. Intellectual Property

Oddah and its logos, design, and technology are owned by us or our licensors. You may not copy, modify, or create derivative works of the Service or our branding without prior written consent. We respect intellectual property rights and respond to valid notices of infringement.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. Oddah is a tool to support your relationship; we are not responsible for any decisions or outcomes in your personal life based on your use of the app. Content and features may change over time.

9. Limitation of Liability

To the maximum extent permitted by law, Oddah and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or profits, arising from your use or inability to use the Service. Our total liability for any claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars (100 USD), whichever is greater. Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless Oddah and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any third-party rights.

11. Governing Law and Disputes

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved in the courts of South Africa, unless otherwise required by mandatory law in your jurisdiction.

12. Changes to the Terms

We may update these Terms from time to time. We will notify you of material changes via the app or by email. Your continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service and may close your account.

13. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of that right. These Terms constitute the entire agreement between you and Oddah regarding the Service and supersede any prior agreements. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of assets.
